Welcome to Brands by POS. By accessing or using this website ("Site"), you agree to comply with and be bound by the following Terms and Conditions. If you do not agree to these terms, please refrain from using the Site.

1. Definitions and Interpretation

• "Site" refers to the Brands by POS website.
• "We," "Us," or "Our" refers to POS Interiors and its affiliated companies.
• "User", "You" or "Your" refers to any individual or business accessing or using the Site.
• "Manufacturer" refers to the suppliers providing the product details, finishes, and pricing displayed on the Site.
• "Wishlist" refers to the feature on the Site where Users can save products for future reference.

2. About Us

• Brands by POS is a brand owned and operated by POS Interiors, a division of Point of Sale Limited ("POS Interiors"), registered in Guernsey under registration number 12154.
• POS Interiors also operates POS Interiors (Jersey) Limited, registered in Jersey under 134563.
• Our registered office address is Unit 9 Anfre Estate, Route de la Garenne, St. Peter Port, Guernsey, GY1 2RL.
• Any reference to "we," "us," or "our" in these Terms refers to POS Interiors and its affiliated companies.

3. Use of the Website

• This Site is intended for use by individuals and businesses seeking furniture solutions within the Channel Islands, and the UK. By accessing this Site, you warrant that you are at least 18 years old and legally capable of entering into a contract.
• The content and tools provided on this Site, including the product configurator, are for informational and illustrative purposes only.

4. Product Information

• All product details, finishes, and pricing displayed on the Site are provided directly by the manufacturers and are subject to change without notice.
• Prices shown include UK VAT unless otherwise stated. Prices may vary based on manufacturer updates, and we do not guarantee price stability. Customers are responsible for checking for price updates before finalising their wishlist or quote submission to ensure accuracy.
• Brands by POS are not responsible for inaccuracies, omissions, or changes in product information provided by manufacturers.

5. Wishlist and Quotes

• Adding products to a wishlist does not constitute a binding agreement or order. Prices at the time of wishlist creation are subject to change based on manufacturer updates.
• Once a wishlist is submitted to Brands by POS for a formal quote, we will issue a detailed quotation specifying valid pricing and a defined validity period (typically 30 days).
• The pricing in a formal quote is guaranteed only for the specified validity period. After this period, prices may be subject to revision.

6. Minimum Order Value

• Brands by POS operates with a minimum order value of £500 (excluding delivery and installation costs). Orders below this threshold will not be processed.
• Delivery and installation charges will be quoted separately and depend on the delivery location and scope of work.

7. Payment Terms

• Full payment is required before orders are placed with manufacturers unless otherwise agreed in writing. Payment must be made within 7 days of receiving the formal invoice to ensure there are no delays to your order.
• Only BACS payment methods are accepted. All payments must be made in GBP.

8. Delivery and Installation

• Delivery timelines will be provided in the formal quote and are subject to manufacturer lead times. Brands by POS will make every effort to meet delivery deadlines but are not liable for delays outside our control.
• Installation services are available upon request and will be quoted separately.
• The customer is responsible for ensuring the delivery location is accessible and ready for furniture installation.

9. Returns and Cancellations

• Customised or configured products are non-returnable and non-refundable unless defective or damaged upon delivery. Defects or damages must be reported within 48 hours of delivery to be eligible for return or replacement.
• Cancellations must be requested in writing and may be subject to charges if the order has already been processed with the manufacturer.
• Any return requests for standard products must be approved in advance and may incur a restocking fee.

10. Intellectual Property

• All content on this Site, including text, images, logos, and tools, is the property of POS Interiors or its licensors and is protected under applicable copyright and trademark laws.
• Users may not reproduce, distribute, or use any content from this Site without prior written consent.

11. Limitation of Liability

• Brands by POS and POS Interiors are not liable for:
  • Errors, inaccuracies, or omissions in product information provided by manufacturers.
  • Any indirect, consequential, or incidental damages arising from the use of the Site or the products purchased.
  • Delays in delivery caused by manufacturers or third-party logistics providers.
• Our total liability under these Terms and Conditions is limited to the value of the products purchased by the customer and excludes liability for indirect, consequential, or punitive damages, except where prohibited by law.

12. Suspension and Termination

• We reserve the right to suspend or terminate access to the Site or services if a User breaches these Terms or engages in unlawful activity.
• Termination does not affect any outstanding obligations owed by the User, including payment for products or services rendered. Outstanding obligations may also include applicable cancellation fees or other costs incurred prior to termination.

13. Force Majeure

• Brands by POS is not liable for delays or failures in performance resulting from events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, governmental actions, or interruptions in utilities or transport.

14. Governing Law and Jurisdiction

• These Terms and Conditions are governed by and construed in accordance with the laws of the Bailiwick of Guernsey.
• Any disputes arising from these Terms or the use of the Site shall be subject to the exclusive jurisdiction of the courts of Guernsey. For orders placed through POS Interiors Jersey Limited, the jurisdiction shall be the courts of Jersey.

15. International Use

• While this Site is accessible to customers outside the Channel Islands and the UK, we do not guarantee compliance with international laws. Customers outside these regions are responsible for ensuring compliance with their local laws. International customers may use the wishlist and configurator features, but Brands by POS does not guarantee the ability to fulfill orders outside the Channel Islands and the UK.

16. Changes to Terms and Conditions

• These Terms and Conditions are subject to change without prior notice. Updates will be posted on this page with the effective date.
• Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
